BTFE Farm Fresh Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The BTFE Farm Fresh Sweepstakes (the “Sweepstakes”) is open only to legal residents of the states of North Carolina and Virginia who are members of BoxTops4Education.com and who are at least eighteen (18) years old at the time of entry. Employees of General Mills Sales, Inc., Arrowhead Promotion & Fulfillment Co. Inc., and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Registration for BoxTops4Education.com is free. Your chosen school must be enrolled in the General Mills Box Tops for Education® Program (the “BTFE Program”) for the 2015 – 2016 academic school year prior to your entering. If your school is not enrolled in the BTFE Program, have your school’s principal or an administrator call 1-888-799-2444 to enroll, or enroll online at http://www.boxtops4education.com. See www.boxtops4education.com for more details about the Box Tops for Education program. The Box Tops for Education-eligible school (“BTFE-Eligible School”) of winner's choice (the “Designated School”) will receive the prize provided that it complies with the requirements set forth in the BTFE Official Rules and these Official Sweepstakes Rules. Each BTFE-Eligible School participating in the Box Tops for Education program may earn up to, but not more than, $20,000 cash per year (beginning on March 2 of every year) from the Clip program. There are no maximum annual earning limits for schools for eBoxTops™ credits or Bonus Box Tops. However, individual eBoxTops™ programs may have independent consumer earning limits based on transactions or activities. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor: General Mills Sales, Inc., One General Mills Blvd., Minneapolis, MN 55440. Administrator: Arrowhead Promotion & Fulfillment Co. Inc., 1105 E 8th Street, Grand Rapids, MN 55745.

3. Timing: The Sweepstakes begins on January 6, 2016 at 12:00 a.m. Eastern Time ("ET") and ends on February 14, 2016 at 11:59 p.m. ET (the "Sweepstakes Period"). Administrator’s computer is the official time-keeping device for this Sweepstakes.

4. How to Enter: There are two (2) ways to enter the Sweepstakes as outlined below:

  1. a. Purchase: During the Sweepstakes Period, purchase any purchase any ten (10) participating General Mills Box Tops for Education products in a single transaction at participating Farm Fresh supermarket stores. Upon making a qualifying purchase, you will receive a mail-in entry form via register receipt (“Mail-In Entry Form”), which must be fully completed (including Designated School with school city and state) and mailed with proper postage affixed via regular mail to: Farm Fresh BTFE Sweepstakes, P.O. Box 3151, Dept. A, Grand Rapids, MN 55745-3151. Mail-In Entry Form must be postmarked by February 15, 2016 and received by February 24, 2016, in order to be eligible. You will receive one (1) entry upon Sponsor’s receipt of your fully completed Mail-In Entry Form. For a complete list of participating products, visit http://www.boxtops4education.com/participating-products - please note that only General Mills products are considered participating products for this Sweepstakes.
  2. b. Without A Purchase: During the Sweepstakes Period, you may receive one (1) entry into the Sweepstakes without making a purchase, by hand printing your name, mailing address (No P.O. Boxes), daytime phone number, email address, and Designated School (including city and state) on a 3 1/2" x 5" piece of paper and mailing it with proper postage affixed via regular mail to: Farm Fresh BTFE Sweepstakes, P.O. Box 3151, Dept. A, Grand Rapids, MN 55745-3151 (“No Purchase Mail-In Request”). Limit: One (1) request per envelope. All No Purchase Mail-In Requests must be handwritten. All No Purchase Mail-In Requests must be postmarked by February 15, 2016 and received by February 24, 2016, in order to be eligible. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.

Each entry must be mailed separately. Entries sent via overnight or via facsimile or copies or mechanical reproductions of entries will not be accepted. Once submitted, entries become the exclusive property of the Sponsor and will not be acknowledged or returned. Limit: One (1) entry per person per day during the Sweepstakes Period regardless of the method of entry. For purposes of the entry via the purchase method, a “day” is understood to mean a calendar day during participating store hours where you make your purchase. For purposes of the entry via the non-purchase method, one “day” is understood to mean one postmarked day.

Entries in excess of the limit on entries prohibited and will result in disqualification. Released Parties (as defined in Section 8, below) are not responsible for postage-due, lost, late, stolen, damaged, incomplete, invalid, unintelligible, illegible, delayed or misdirected entries. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.

5. Potential Winners Selection. Sponsor will select five (5) potential winners – the Grand Prize, 2nd Place, 3rd Place, 4th Place and 5th Place winners (each a “Potential Winner”) at random on or about February 27, 2016 from all eligible entries received. By entering, you grant permission to be contacted by Sponsor by mail or telephone in connection with the Sweepstakes. You must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements set forth herein. A Potential Winner is not an official winner (“Official Winner”) until Potential Winner’s eligibility has been verified and Potential Winner has been notified that verification is complete. Sponsor’s decisions are final and binding in all matters related to the Sweepstakes.

6. Verification of Potential Winner. Potential Winners may be required to sign and return an Affidavit of Eligibility & Publicity Release (unless prohibited) (collectively an "Affidavit"), which must be received by Sponsor within five (5) days of the date on the notice. If a Potential Winner cannot be contacted, fails to execute and return the Affidavit or provide any other requested information within the required time period or prize is returned as undeliverable or he/she refuses his/her prize for any reason, that Potential Winner forfeits the prize and Sponsor will select an alternate winner by random drawing. At least five (5) alternate drawings will be held after which the prize may, in Sponsor's sole discretion, remain un-awarded. Notwithstanding the foregoing, Sponsor shall use best efforts to award all prizes listed in these official rules.

7. Prizes: Prizes (5):

Grand Prize: One (1) Grand Prize winner’s Designated School will receive Ten Thousand (10,000) Bonus Box Tops. Approximate Retail Value (“ARV”): $1,000.00 to Official Winner’s Designated School.

2nd Place Prize: One (1) 2nd Place winner’s Designated School will receive Two Thousand (2,000) Bonus Box Tops. Approximate Retail Value (“ARV”): $200.00 to Official Winner’s Designated School.

3rd Place Prize: One (1) 3rd Place winner’s Designated School will receive One Thousand Five Hundred (1,500) Bonus Box Tops. Approximate Retail Value (“ARV”): $150.00 to Official Winner’s Designated School.

4th Place Prize: One (1) 4th Place winner’s Designated School will receive One Thousand (1,000) Bonus Box Tops. Approximate Retail Value (“ARV”): $100.00 to Official Winner’s Designated School.

5th Place Prize: One (1) 5th Place winner’s Designated School will receive Five Hundred (500) Bonus Box Tops. Approximate Retail Value (“ARV”): $50.00 to Official Winner’s Designated School.

Winners will be invited to attend an in-store event on March 12, 2016, but are not required to attend in order to claim a prize. Bonus Box Tops will be credited to Official Winner’s Designated School’s BTFE account. One (1) Bonus Box Top is equal to one (1) Box Top ($.10) and will be automatically credited to the Designated School's account, subject to the BTFE Program guidelines available at www.boxtops4education.com. No prizes will be awarded to the individual.

Odds of winning are based on the number of eligible entries received. No cash or other substitution, assignment or transfer of any prizes is permitted, except by Sponsor, who reserves the right to substitute a prize or prize component with cash or another prize of comparable or greater value. The winners’ Designated Schools are responsible for all (if any) federal, state, and local taxes and fees associated with prize receipt and/or use.

8. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any losses, damages, rights, claims or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

9. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries or plays received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry or play is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Sweepstakes entry, if possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

12. Disputes: Except where prohibited, by participating, you agree that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the appropriate Minnesota State Court located in Minneapolis, Minnesota; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will you be permitted to obtain awards for and you hereby waive all rights to claim indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
